2. Purpose and acceptance

These terms and conditions (hereinafter, “the Terms”) govern the relationship between the owner (holder of ANDO) and the user who accesses the website ando.tours or uses the ANDO mobile application.

Access to and use of the Platform implies express acceptance of these Terms in their current version at the time of each use. If you do not agree, you must refrain from using the Platform.

3. Description of the service

ANDO is a tourist audio guide platform. The user purchases a route on ando.tours, receives a unique access code by email and redeems it in the ANDO mobile application (available for iOS and Android) to download and play the route audio offline.

Service features:

• Each access code is personal and non-transferable, valid for a single mobile device.
• The code can be redeemed at any time from the date of purchase, with no time limit.
• Once the code is redeemed, the user has 48 hours to listen to the route from that moment.
• The audio is downloaded encrypted to the device and is automatically deleted when the access period expires.
• Playback is fully offline once the audio has been downloaded. An internet connection is only required for the initial download.

4. Purchase process

To purchase a route, the user must:

1. Select the desired route and language on ando.tours.
2. Provide billing details and make payment by credit or debit card through the secure Stripe payment gateway.
3. A confirmation email with the access code will be sent once the payment has been processed.

Prices include applicable VAT. The final price is clearly displayed before completing the purchase.

5. Right of withdrawal

As this is digital content (audio downloaded at the user’s request), the right of withdrawal provided for in Article 103(m) of Royal Legislative Decree 1/2007 does not apply once the user has redeemed the access code and initiated the audio download.

However, if the code has not been redeemed, the user may request a full refund within 14 calendar days from the date of purchase by contacting ando@ando.tours.

6. Refund policy

• Code not redeemed: full refund if requested within 14 days of purchase.
• Code redeemed but audio not played: assessed on a case-by-case basis. Contact ando@ando.tours.
• Technical issue attributable to ANDO: full refund or new code, at the user’s choice.
• Code expired due to user inactivity: no refund applies.

7. Correct use of the app and codes

The user agrees to:

• Not share, transfer or resell access codes.
• Not attempt to decrypt, copy or redistribute downloaded audio.
• Not use the Platform in a manner contrary to the law, morality or public order.
• Not use technical means to circumvent the service’s protection systems (AES-256, signed URLs, rate limiting).

Breach of these conditions may result in the deactivation of the code and the account, without the right to a refund.

8. Service availability

ANDO endeavours to keep the service available continuously but does not guarantee the absence of interruptions due to maintenance, updates or force majeure. Maintenance tasks will preferably be carried out during off-peak hours.

9. Intellectual property

All content on the Platform, including audio, scripts, ambient music, sound effects, photographs and design, is protected by intellectual property rights. The user only acquires a limited, personal and non-transferable licence for personal and non-commercial use of the purchased content.

10. Liability

ANDO shall not be liable for damages arising from:

• Incompatible, broken or insufficient-storage mobile devices.
• Data loss caused by the user uninstalling the app.
• Weather conditions, closure of public spaces or other external circumstances that prevent the route from being completed.
• Use of the Platform contrary to these Terms.

11. Amendment of the terms

The owner reserves the right to amend these Terms at any time. Changes will be published on this page with the date of update. Continued use of the Platform after publication of the changes implies acceptance of the new Terms.

12. Governing law and jurisdiction

These Terms are governed by Spanish law. For any dispute, the parties submit to the courts and tribunals of Barcelona, without prejudice to the consumer protection rights recognised by European and Spanish law.
